Zamag Booking Conditions

1. Scope & Acceptance
All bookings accepted and safaris sold by Zamag Tours & Safaris ("The Company") are subject to these terms and conditions. Payment of a deposit or any portion of the tour price is deemed full acceptance of these terms and conditions.

2. Reservations & Payments
All reservations are confirmed upon receipt of a non-refundable 25% deposit. The final balance owing must be paid by the date stipulated on your invoice or booking confirmation (typically 8 weeks prior to departure). Failure to pay the balance by the due date means the Company may treat your booking as cancelled and levy the cancellation charges set out below. All payments must be made via bank transfer to the Company’s designated bank account, with all bank transfer and intermediary fees covered by the client.

3. Cancellations & Refunds
Any cancellation of a booking must be made in writing by the client. Cancellation charges are expressed as a percentage of the total tour price and apply as follows:
•    Cancellation after deposit paid: Deposit is forfeited.
•    8 weeks before departure: 50% of the total tour price is forfeited.
•    6 weeks after departure: 75% of the total tour is forfeited
•    4 weeks or less before departure: 100% of the total tour price is forfeited.
Note: During peak season periods, the Company reserves the right to alter these cancellation policies should our third-party suppliers and lodges apply stricter penalties. Every reasonable effort will be made to recover, defer, or refund payments on behalf of the client (less any reasonable administrative expenses incurred in the process), but the Company remains strictly bound by the cancellation terms of the various lodges, camps, and transport providers.

4. Force Majeure
The Company accepts no liability and will not pay any compensation, refunds, or expenses where the performance of our contractual obligations is prevented or affected by "Force Majeure". Force Majeure means any event beyond our control or the control of our suppliers, the consequences of which could not have been avoided even if all reasonable measures had been exercised.
Such events may include, but are not limited to: war or threat of war, civil unrest, terrorist activity or industrial disputes; natural or nuclear disasters, extreme weather conditions, fire, floods, or drought; epidemics, pandemics, or significant health risks; closure of airports, ports, or airspace; government actions, border closures, or restrictions.
In the event that a safari or tour is cancelled, interrupted, or altered due to Force Majeure, the Company will use its best endeavors to negotiate and obtain refunds, credits, or deferred booking options from third-party lodges, camps, and transport providers on behalf of the client. However, the client acknowledges that the Company is ultimately bound by the cancellation and credit terms of these independent suppliers. Any recoveries, refunds, or credits passed on to the client will be net of any unrecoverable third-party costs and reasonable administrative expenses incurred by the Company.

5. Travel Insurance
It is essential and mandatory that all guests be comprehensively covered by personal travel insurance prior to departure. This insurance must cover personal accident, emergency medical expenses, medical evacuation, loss or damage of personal effects, repatriation costs, and cancellation/curtailment expenses. Insurance cover should ideally be arranged at the exact time of paying the deposit to protect against unforeseen cancellation penalties.

6. Passports, Visas, and Health Requirements
The responsibility to obtain proper, current, and valid passports, visas, vaccinations, inoculations, and any other health certificates required for travel lies solely with the client. The Company shall not be responsible or liable for any consequences, costs, or losses arising from the client's failure to comply with these requirements.

7. Personal Information & Privacy
To process your booking, we collect personal information such as full names, passport numbers, emergency contacts, dietary requirements, and medical details. This information is processed in accordance with the Data Protection Act No. 3 of 2021 of Zambia. For full details on how we safeguard, process, and store your personal data, please refer to our Privacy Policy available on our website.

8. Responsibility & Agency
• Third-Party Arrangements: All arrangements for transport, accommodation, tours, and other services are made by the Company as agents only. Neither the Company nor its employees shall be liable for any loss, damage, injury, accident, delay, or irregularity arising directly or indirectly from these arrangements unless caused by the proven negligence of the Company.
• Government & Park Fee Increases: Should the government of the visited country increase any national park fees, tourism levies, airport departure taxes, or government taxes beyond the Company's control, these additional fees will automatically be passed on to the client.
• Carrier Conditions: All air and surface journeys are subject to the specific terms, conditions, and liability limitations of the respective carriers.

9. Unscheduled Extensions & Breakaways
In the event of an unscheduled holiday extension or delay caused by flight delays, mechanical breakdowns, severe weather, or any other cause beyond the control of the Company, all expenses relating to such extensions (accommodation, meals, alternative transport) will be for the client's account. Similarly, if a client chooses to break away from the planned itinerary, any extra expenses incurred will be for their own account, and no refunds will be given for unused services.

10. Guides, Wild Animals & Indemnity
• Guides & Tour Leaders: The Company reserves the right to substitute or change contracted guides or tour leaders at any time. Such changes do not constitute a valid reason for client cancellation or refund.
• Wild Animals: Safaris frequently take clients into close proximity with wild animals. While attacks are rare, the Company cannot guarantee safety and accepts no responsibility or liability for any injury, loss, or damage caused by wild animals.
• Optional Activities & Indemnity: Clients may participate in optional activities provided by independent suppliers (e.g. walking safaris, water activities, scenic flights). These activities carry inherent risks. Participation is entirely at the client's own risk, and the Company assumes no liability for safety or incidents arising during these activities.

11. Governing Law
These booking conditions and any disputes or claims arising out of them shall be governed by and construed in accordance with the laws of the Republic of Zambia.
